What Is Probate?
After a person passes on, the probate process begins. In probate, a court proves the validity of a will. The court also appoints an executor to distribute the estate according to the will's specifications. In distributing assets, the executor must deal with tax issues, arrange for payment of any debts, etc.
Not everything must go through the probate process. Some assets do not apply; life insurance proceeds, for example, are not probatable. And if assets have already been arranged in the form of trusts, for example, you can avoid probate entirely. This cannot be done after the person has passed on, however -- it must be done during
estate planning.
